Academic Information

TERMS, CONDITIONS, AND RELEASE OF LIABILITY AGREEMENT

I, the undersigned, hereby acknowledge that I am over the age of 18 and that I have the authority to make agreements on behalf of myself. I further acknowledge that I have voluntarily chosen to enroll in the Manhattan College Non-Credit Program.

ACCEPTANCE OF RISKS AND RELEASE FROM LIABILITY

I understand that certain risks are inherent in any hands-on educational activity. I agree that there may be a risk of injury or harm as a result of program activities, and I knowingly and voluntarily assume all risks of such injury or harm. I also understand and agree that it is my responsibility to safeguard personal belongings, and I knowingly and voluntarily assume all risks that personal belongings brought to the program may be lost, misplaced, damaged, or stolen. I hereby waive and release Manhattan College (and its owners, agents, partners, representatives, employees, contractors, and program staff) from any and all claims, injuries, causes, actions, liabilities, demands, losses, legal or equitable, of any kind whatsoever arising out of or in any way related to any loss or damage of property, injury, illness, disease, loss of services, medical bills, charges or otherwise, including death, which may arise out of or in any way be related to me participating in the program, whether occurring inside, on, outside, or off college property, during participation in the program or related activities and for the duration of said activities and whether known or unknown, foreseen or unforeseen, including any and all legal and attorneys' fees and court costs.

SAFETY & CONDUCT

For everyone’s safety, you must follow all staff instructions. I understand that if my actions or attitude are deemed detrimental to other program participants, program staff, the safety of the program, or the general program atmosphere, I may be asked to leave the program. I agree to accept full responsibility, financially or otherwise, for my conduct — including paying restitution for damage to college/school equipment and property, program facilities, and/or personal property of other participants. Manhattan College is not required or expected to protect program participants from theft or damage to property.

MEDICAL AUTHORIZATION & SPECIAL NEEDS

I understand and agree that I am responsible for determining my medical, physical or other qualifications and suitability for participating in the program and its activities (including games and instruction). I agree to disclose to college and program staff any pertinent medical, physical, or other conditions and special needs that may affect my participation in these activities. I understand measures will be taken to safeguard the health and safety of all participants; however, in the event of need, I hereby grant permission to Manhattan College or its authorized representatives to arrange for such medical care that I may require. This includes minor medical care by Manhattan College staff members. In the event of serious injury or illness, the staff will call 911. The staff will also use all reasonable efforts to contact people listed as emergency contacts. I am aware that college assumes no liability for the costs or provision of medical care in the event that care is needed during or after this program. It is my responsibility to comply with any Manhattan College, New York City, and United States policies previous to my arrival and participation at the program.

SUMMER 2022 COVID PROTOCOLS (OVERNIGHT CLIENTS)

The health and safety of the Manhattan College community and campus visitors continue to be the highest priority. As of today, the following are protocols all overnight guests are required to abide by.
● Upon check-in all overnight guests will need to show proof of:
o Full vaccination (this is defined as receiving two doses, out of a two-dose series, or one dose out of a one-dose series, with the addition of a COVID-19 booster shot)
▪ Acceptable forms include a vaccination card (hard copy or digital photo)
o Photo ID
▪ Acceptable forms include a driver’s license, passport, or school ID
o Completion of the One Manhattan COVID-19 Waiver form
● When indoors, masks must be worn at all times unless seated and actively eating.
● When entering identified campus locations (residence hall lobbies, dining hall, Kelly Commons, etc), signage will be posted and overnight guests will be required to swipe their Conference Services issued ID card, attesting to not having any symptoms at the point of entry.
● Visitors will be expected to adhere to all campus COVID-19-related protocols shared by Manhattan College. A failure in compliance will be reported using the Visitors Campus Health & Safety Violation form. Each report will be reviewed and could lead to possible campus eviction.
● Visitors who develop symptoms or realize health-related issues during their stay must report such to their on-site program Director or leadership team member. All such individuals will then be required to take a COVID-19 Antigen Rapid test. COVID-19 Antigen Rapid tests will be available for purchase through the Office of Conference Services at a predetermined cost to the client, or the client may choose to supply its own COVID-19 Antigen Rapid tests.
● It is the responsibility of the client to immediately notify the Office of Conference Services management staff of each COVID-19 POSITIVE occurrence.
● In the event of a POSITIVE test result, guests must isolate as soon as possible or within 24 hours. If a guest lives locally (within 25 miles of campus), and has the means to return home they must isolate off-campus.
● If a guest tests POSITIVE and is unable to return home for isolation, the College will provide an on-campus isolation room based on single occupancy (one person per room, two people per suite, sharing a bathroom). Isolation rooms are limited and availability will be evaluated at the time of the request.
● If a guest is required to isolate on-campus, the client is responsible for:
o Daily virtual or phone wellness checks
o Ensure meal ordering
o Meal pickup (from Locke’s) and delivery (outside suite door) at designated times
● A valid and working email address is required for each overnight guest, as outlined on the housing chart. Clients are responsible for ensuring any overnight guests are complying with and actively participating in Manhattan College's contact tracing program.
● If the guest and/or his/her program management decides the individual needs to leave campus following initial check-in, the guest and program will NOT be subject to refunds or credits for the balance of the stay.
● All visitors in isolation accommodations who stay beyond their scheduled program departure date will be evaluated for rooming availability and will be charged for the additional housing accommodations and meals through final departure. Management staff must also stay for this duration of time, if beyond the end of the program date.

These protocols are subject to change and revision based on Manhattan College, New York City, New York State, and Federal mandates on COVID-19-related matters.
Failure to comply with Manhattan College policies regarding its Standard Code of Conduct or these COVID-19 related protocols will be subject to having guest accommodations revoked and asked to leave campus.
If the participant leaves campus accommodations due to their failure to comply with such policies and protocols will not be eligible for refunds or credits to their prepaid stay.

PHOTO & VIDEO RELEASE

Some program sessions may be videotaped or photographed. By registering for this program, I grant permission for the use of my image and voice, which may be captured by video, photo, digital camera or other media, for college training, promotional materials, publications, and other marketing purposes.

CANCELLATIONS, REFUND PROCESSING & CHANGES

Manhattan College reserves the right to vary its programs and to reschedule or cancel an event if it is under-subscribed or for any other reason. Manhattan College attempts to give participants at least two (2) weeks’ notice if an event is rescheduled or canceled. Please make sure you provide a valid email address and phone number during registration. If Manhattan College cancels events for any reason, you will receive a full refund less a one-time processing fee of $100.00 (if applicable). If the participant cancels attendance to the program for any reason and provides at least two (2) weeks’ notice of cancellation before the program start day, the participant will also be entitled to a full refund less the one-time processing fee of $100.00 (if applicable). Cancellation of program attendance by the participant with less than two (2) weeks’ notice forfeits the participant’s rights to a refund. Also, please keep in mind that refund processing usually takes 4 – 6 weeks (this time frame is dependent upon your financial institution).

GOVERNING LAW, JURISDICTION & MEDIATION

I acknowledge that this Agreement shall be governed in accordance with the laws of the State of New York. I consent to the exclusive jurisdiction and venue of the federal and state courts located in New York in any litigation arising out of or relating to this Agreement.

I agree that any dispute arising out of or relating to this Agreement shall first be attempted to be resolved by non-binding mediation. Mediation shall be held in the state and county in which the program is held. The mediation provision may be enforced by either party to this Agreement.

I hereby acknowledge that I agree to and will comply with the terms of the mediation provision. Should any part of this Agreement be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and enforceable.

This Agreement constitutes the entire Agreement between Manhattan College and me.

I acknowledge that I have read and agreed to all the terms set forth in this Agreement.
